Power of administrative supervision

The subject of this study is the power of administrative supervision in Turkish Administrative Law. The power of administrative supervision is the supervision of central administration over local administrations within the context of administrative integrity. Since it is an administrative supervision it must be distinguished from political supervision and especially judicial supervision. Administrative supervision is different in procedure, substance and purpose from other kinds of supervision. Administrative supervision must be restricted so as not to damage the authonomy of the local administrations however it must be made effectively to protect the administrative integrity and this restriction must not leave the local administrations without efficient supervision. Administrative supervision is a special supervision power which is different from other kinds of supervisions. This power should only be applied over local adminitrations i.e. special provincial administrations, municipalities and village administrations. Article 127/5 of the Constitution deals with the power of administrative supervision. For this reason, in this thesis the power of administrative supervision is examined within the framework of that provision of Constitution. The first chapter deals with supervision and types of supervision control over local adminisrations in general. The second chapter focuses on the meaning, scope, purpose and historical background of administrative supervision. The third chapter examines agencies which has power of adminintrative supervision and agencies which are subject to this supervision in Turkish administrative law. The conditions and requirements to use the power of administrative supervision are examined in the final chapter. These explanations are enriched by examples in legislation and court decisions.
