Abstract (EN)

One of the necessity of the Law Abiding State is the Judicial control of the administration. But the application of the jurisdiction is as important as the judicial control over the Executive branch of the state. There is no importance of the Administrative Jurisdiction at a state where the court decisions are not applied. The mechanism that ensures the application of rulings by the administration is the legal term. Because the administration has to apply the verdicts in a certain period of time. By doing so, the invidual rights and freedoms are under guarantee and the Law Abiding State principle would be established. As a matter of fact the standard procedure should be the application of the verdicts without the sanctions. But especially at the devoloping countries where the Law Abiding State principle has not been established , it is inevitable to impose sanctions and legal arrangements at the application of the jurisdictions.Failure to comply with the application of the court rulings in the legal term holds the administration responsible under the legal arrengements. In this case the administration, culpable or not because of noncompliance of applying the jurisdiction will be liable of the losses.
