Abstract (EN)

In our administrative justice system, the procedure for the resolution of disputes, which is based on the written trial principle, has found application area for many years. The long duration of some administrative lawsuits creates uncertainty regarding the effectiveness of the decision to be made as a result of the trial, both for the plaintiffs and the defendant administrations. In this context, some arrangements have been made within the framework of the emerging needs for faster resolution of some disputes due to their nature. With the Laws No. 6545 and 6552 on Administrative Judgment Procedure numbered 2577, "immediate trial procedure" and "trial procedure regarding central and common examinations" were added to the Law No. Within the scope of this regulation, some periods in the trial process were shortened, and some of the institutions applied in the general trial procedure were abolished in terms of disputes subject to the special trial procedure. In this study titled "Special Judicial Procedures In Administrative Jurisdiction Law", a general framework will be drawn regarding the concept of trial, followed by trial procedures; The relevant legislation provisions, opinions in the doctrine, judicial decisions and current developments will be examined. In addition, the appearance and application area of the urgent trial procedure will be tried to be conveyed in the example of France, which was inspired when the regulation was made. Keywords: Administrative Jurisdiction, Proceedings, Immediate Proceedings, Judgment of Central and Common Examinations, Special Proceedings, French Administrative Judicial System.
