Abstract (EN)
Bankruptcy is one of the real commercial life. However traders, they would go bankrupt with unlawful acts, these actions will be punished. The crime soccurred in there sult of this action are Bankruptcy Crimes. Fraudulent bankruptcy, refers to the deletion of the property by fraudulent savings. So in the Turkish Penal Code (Law No:5237) fraudulent bankrupt (Art.161) and negligent bankrupt (Art.162) are criminalized. The previous Penal Code (Law No:765) also included Bankruptcy Crimes but only the sanction of crimes, not the element of crimes. Interms of the elements of thecrime, Execution and Bankruptcy Law (Law No:2004)in our existing regulations. In this thesis elements of bankruptcy crimes are discussed and the possible effects of then regulation are tried to be determined.
