Abstract (EN)
In our country, retail drug supply to consumers is only done through pharmacies. Pharmacists sign the Drug Supply Agreement, which is a private law contract with the Social Security Institution for this drug supply process. One side of the Drug Supply Agreement is the Social Security Institution, which has the status of a public institution, and the other side is the pharmacists, who have the status of merchants. During the Drug Supply Agreement negotiation process, the Turkish Pharmacists Association has been authorized on behalf of the pharmacists within the scope of Law No. 6643. Since the general transaction conditions audit that came into force with the Turkish Code of Obligations does not have a personal application limit, pharmacists who are merchants should also benefit from this protection. The Drug Supply Agreement is a standard contract and is subject to court review. In this context, the relevant contract provisions will undergo the control fort the operation, the control fort the interpretation and the control fort he content review. In our study, the rights and obligations of the parties, court decisions, audit processes and the protection of pharmacists against general transaction conditions were evaluated. In the conclusion section of the study, the opinion reached, its leader and results are given.
