Abstract (EN)
The crime of zoning pollution; with No. 5237 Turkish Criminal Code was the first time that it was punishable. Of course, the movements that caused the action to cause zoning pollution were also committed before being accepted as a crime in the TCK. However, these acts were only misdemeaned and subjected to various administrative sanctions. In the context of harmonization with European Union Law, the protection of crimes against environment by means of criminal law is a new phenomenon. The de facto cause of zoning pollution is one of the crimes against the environment and it has been deemed appropriate to be protected by criminal law. One of the points emphasized in our thesis is to what extent the protection of crime against the environmental crimes by criminal law is ensured. The crime of causing zoning pollution, which is the subject of our thesis, has three typical acts. These are respectively; building or building a building in violation of license or construction, permitting the connection of electricity, water or telephone to the construction sites established for construction without construction license, and finally permitting the execution of any industrial activity in buildings without building permit. The study was examined separately with three separate acts, and comparisons were made with the first text presented to the General Assembly of the Parliament before it was enacted.
