Right to avoid the construction agreement due to defects in the building

The main subject of this study is the right of the customer to avoid the construction agreement due to defects in the building. Within this context; in the first section; the features of the construction agreement are mentioned through evaluating the definition, the elements, the parties, the form and the legal nature of the contract. In the second section, the defect is reviewed specifically in the concept of the construction agreement and the rights of the customer confronting the defect in the building are described. As for the last section; the consequences of the avoidance of the customer are defined and within this scope; the legal nature of the avoidance and its effects on the obligations of the parties whether or not performed has been analysed.
