Abstract (EN)
In this doctoral thesis titled "Rights of Turkish Immigrants in Austria within the Framework of Human and Minority Rights"; The adequacy levels of the rights of Turkish immigrants living in Austria in political, economic, social, cultural, religious and linguistic fields are evaluated in terms of human and minority rights by compa-ring them with the rights of other immigrant minority groups. In the first part of the thesis, which starts with a literature review on human and minority rights, definition of rights are given within the framework of different expert opinions, focusing on the components of collective rights within the scope of human rights and especially third generation rights and the minority rights conventi-ons ratified by international organisations such as the UN, OSCE, Council of Europe and the EU. In the second part, the history of the phenomenon of migration, the historical course of the migration waves that Austria has been exposed to, and the policies imp-lemented by the Austrian state in the context of the rights granted to migrants are analysed. Instead of a uniform state policy towards immigrants from different count-ries, the dichotomy created by the multi-layered state policy in terms of the rights granted to immigrants is pointed out. While trying to explain what the political, social, economic, cultural, religious and linguistic rights of all immigrants living in Austria are, it has been tried to analyse in all dimensions what rights the relevant immigrant groups are deprived of and espe-cially for which reasons their access to these rights is prevented. In the last part of the thesis, the rights granted to Turkish immigrants and the adequacy of these rights in terms of human and minority rights are questioned, and problem areas were determined by making comparisons with the rights granted to other immigrant groups. Obstacles for immigrants, such as the heavy conditions for obtaining Austrian citizenship, were emphasised. It was emphasised how such problems have grown exponentially over time and their continuity, and within the scope of suggestions for their solution, the issue of raising awareness of values such as coexistence and respect for the other was emphasised. It was pointed out that Austria should adhere to the values such as democracy, human rights, rights, rule of law and justice, which are considered as the basic norms at the founding of the EU, otherwise all segments living in Austria may be harmed by this process. It was emphasised that Austria is the home of all immigrants together with the natives of Austria and that the welfare levels of all segments of the population living in Austria can be increased if the people living in Austria act within the framework of mutual solidarity, benefit will be reached for all.
