Abstract (EN)
Principle of separation between the organs is considered to be one of the key issues in terms of the occurrence of problems to designate the councils that would undertake the governmental roles, and further of laying down their functions and setting the relationships between the organs.This research is focused on the principle of separation of Constitutional organs promulgated during the period 1925-2005. The essence of the issue is underpinned at the fact that accordingly the political governmental style can be established and the problem prevailing between the government and independence can be remedied to the benefit of the government, securing the balance between them.All the topics above constituted the curriculum of the three sections. In the first section, we had studied the principle of separation between the organs (an introductory research on common principles). In the second section, the principle of separation between the organs of the Constitutions enacted during the period 1925-1968 was studied. The Constitution of 1925 (Fundamental law) had adopted the parliamentary monarchy system whereas other Constitutions enacted in 1958, 1963 and 1964 were predominantly concentrated on the republican system. In monarchy, the three key organs of the state were headed by a single person or council, implying the assignment of public government to a single council or person. Besides, such government was also being accompanied by other councils, yet they were not active and were commissioned with secondary roles.In the third section, the principle of separation between the organs of Constitution of 1968, 1970 and the latest 2005 was studied. Government in the Constitution of 1968 and 1970 was being undertaken by the President and the Revolutionary Command Council that was representing the volition of the revolution in Iraq. The Constitution of 2005 (the last one) has delegated additional powers to the legislative body and restricted the act of the parliament. Consequently, the national grand assembly had gained ascendancy over the parliament. Furthermore, this Constitution has granted various powers to the President, leading to the recession of the prime minister?s and the parliament?s role.
