Void termination and the provisions and consequences of the void termination in Labour Law

In a limited sense, ?the work security? means protecting the workers against termination. Work Security Organisation has evaluated by the Labour Law 4857 of 22.05.2003. As a rule, the voidness of termination may be stated as not denoting a reasonable case or the voidness of denoted case on the termination notification. However,altough voidness of termination is understood as not containing a reasonable case ,so as a termination not based on a reasonable case, , a set of clauses has been determined for termination process in Labour Law Article 19. Employee can appeal an objection case to termination against employer by maintaining voidness of termination. Shall the case is acepted, the voidness of termination becomes confirmed by the court. However, for becoming effective of this judgement, employee must request his starting to work by applying to employer in the time period cited in law. The consequences of void termination arise considering whether employee has applied to employer. Shall employee starts to work by applying to employer, work relation continues uninterrupted as if termination has never done. In spite of this, unless employee is started to work, work contract ceases and work security compensation is paid to employee by employer.
