Abstract (EN)
The Code of Obligations numbered 6098 and The Code of Labour numbered 4857 contain contractual relations. As a result of these regulations, both codes have the similar regulations about labour contract. Any contractual relationships bring with some rights and responsibilities to one or every part of the contract. In terms of labour contract, principal obligation for an employee is executing a work. The principal obligation for an employer is paying the wages The parts of contract do not always fulfil their debts. In some situations, the parts of contract are not fulfilled their obligations completely as in some situations the parts of contract are not fulfilled partly. There are several reasons for not fulfilling the contract completely. One of these reasons is that fulfilling is not in the time. Failure of one part of the contract is defined default by law order. Failure to fulfilment of the debtor which fulfilling is not in the time is defined default of debtor. The order of law has some consequences in case of default of debtor. Both side of labour contract which are employee and employer might be in a situation of default about several executions and responsibilities. In this thesis, default of executing a work which is the most important responsibilities of employee, is going to be handled. While default of executing a work is examined, default of debtor is going to be explained primarily. Thereafter, what should we understand from an executing a work is going to be explained. Immediately afterwards, in which situations an employee will default is going to be determined. Right after that issue, what sort of legal rights an employer has in the result of the default of employee are going to be determined as well. In this thesis, default of paying the wages which is the most important responsibilities of employer, is going to be dealt with. While default of paying the wages is examined, default of debtor is going to be explained primarily. Thereafter, what should be understood from paying the wages is going to be explained. Immediately afterwards, in which situations an employer will default is going to be determined. Right after that issue, what sort of legal rights an employee has in the result of the default of employer are going to be determined as well.
