Abstract (EN)
This study is concerned with the mediation institution whic is made a condition to apply before a lawsuit, disputes, and their resolutions in labor relations. This work is leaded by the process of mediation application which is thought to assists labor law in Turkey, in recent years, disputes that are arising in consequence of this process and their resolutions. Fort he purposes set out in this argument, legal arrangements related with mediation, claims that submitting demands which are arising from business disputes to the mediation institutions is against the quiding principle of both law constitution and labor law, and the problems generating from mediators and parties are all examned under the scope of the Labor Law No 7036. In order to achieve coherent findings and results the Law No 6325 Law On Mediation In Civil Dısputes, Mediation Fee, Mediation Ethical Committee, the Law No 7036 The law on labor Courts and Mediation as a Precondition to File a Lawsuit, The Law No 7155 which is on the Procedure for Starting the Follow-up Money Receivables from Subscription Agreements and implementing regulations of practice of the law are discussed in general terms.
