Abstract (EN)

This thesis, titled "Rights of Individuals with Autism in Terms of Islamic Law" aims to systematically examine the rights of individuals with autism within the framework of Islamic law, centering on the Islamic principles of protecting the rights of disadvantaged groups. The scattered treatment of this issue in Islamic jurisprudence and the increasing awareness in the modern era highlight the necessity of a comprehensive study in this field. This research will consolidate relevant information within Islamic law, address the rights and needs of individuals with autism in detail, and scientifically reveal the roots of similar regulations in modern legal systems within Islamic law. The primary objectives of the thesis are to clarify the significance and binding nature of the rights of individuals with autism in Islamic law, to foster awareness and a sense of responsibility among families, society, and the state regarding this issue, to contribute to the social inclusion of individuals with autism through the recognition of their rights, and to emphasize the comprehensive approach of Islamic law in this regard. The fundamental research problem is to determine how the rights of individuals with autism, whose numbers are increasing and who have complex needs, are addressed within the framework of Islamic law and what these rights entail. To achieve this, deductive and analytical methods will be employed, religious texts will be examined, the views of different schools of Islamic jurisprudence will be compared, evidence will be evaluated, and solutions will be generated within the rules of Islamic jurisprudence. The research encompasses all individuals diagnosed with autism and is based on a theoretical investigation. By examining the rights of individuals with autism in Islamic law in detail, this study aims to fill the gap in the literature, raise awareness, and make valuable contributions to both Islamic sciences and the fields of social policy and law. By re-evaluating Islam's compassionate approach towards disadvantaged individuals on a scientific basis, this research has the potential to offer solutions to similar problems in the contemporary world from an Islamic perspective.
