Family issues and solutions in Islamic law (Examples of Diyarbakir Shar'iyye Records)

In every period of human history, it is important to understand the ways in which domestic dispute has occurred in order to offer solutions. In the Islamic family system, the term nushūz is used to refer to the problems that may arise between husband and wife. The fact that nushūz and other related terms are mentioned in the Holy Qur'an signifies the importance of the issue.In this study, we have tried to identify the situations that may cause domestic disputes; we have examined the terms nushūz, shiqāq, and irāz and tried to determine which situations these terms are used to define and their place in the Islamic legal field. How these terms were practiced and whether they can be found in the Diyarbakır Shar'iyye Records have been examined. The solution proposals and legal consequences of the cases of nushūz between husband and wife have been analyzed. This thesis yields, domestic rights and responsibilities in Islam, nushūz, which is defined as domestic disputes, and related terms have been researched, and the data obtained from the shar'iyye records, if any, have been presented in this order. In addition, efforts have been made to make it easier to understand in today's Turkish. The solution and legal consequences of the nushūz between husband and wife have been analyzed and in this context, examples from the Sharia records have been given.
