Abstract (EN)

In the Islamic Law marriage efficiency is concerned with the coming age of marriage and also with guardianship. There is no conflict about the entire efficiency of the man on marriage. But whether the woman can get married without a guardian is a disputed supject. According to Civil Law, each female and each male who has reached the age of marriae, can get marriedge. On the other hand the system of divorce, works in three ways according to the Islamic law: The one sided divorcing of each couple, the divorcing by agreeing with each another and the separating of the judge the two couples. On the one sided divorce, the man has got entire authority. The woman, however, is given this authority only if the husband turns her this right over. According to Civil Law the couples can only get divorced by applying to the judge. i*<
