Application of Sedd-i Zerai proof in Islamic Law

Abstract (EN)

Islamic law aims at providing people?s affairs of this life and hereafter. To accomplish this, Islamic law prevents the ways and the causes to the prohibited acts and behaviors that are regarded as outlaw, by application of ?Sedd-i Zerai Proof?.The aim of this study is to indicate that Sedd-i Zerai Proof in Islamic law abolishes the applications that may cause disorder even though these behaviors themselves are not considered to be unlawful.Sedd-i Zerai that means ?the shutting of roads to evil? has been widely applied in the area of Islamic law. Mostly, it has been accepted by the leaders of main sects. In Islamic law, Malikis, Hanbalis, and Hanafis have recognized Sedd-i Zerai as a proof and have formed statements based on this proof. Although Shafi?is has regarded it as weak in evidence, in some operations it is seen that they practice the principle of Sedd-i Zerai. The acceptance of this principle and forming statements based upon this proof grounds adopting given statements.To finalize, Sedd-i Zerai proof has been regarded as an evident principle that makes life easier and is helpful since it provides answers to the contemporary issues of changing and developing life.Key Words : 1) Mean, 2) Prevention, 3) Evidence, 4) Comparison
