Abstract (EN)

Muwāsāt is an important concept that includes the obligation of assistance and notification. It aims to ensure social order, help those in difficult situations and meet the needs of those in need. The subject of this research, muwāsāt, has a much broader content than the obligation of assistance and notification in positive law. For this reason, many secondary issues involving the obligation to provide assistance have had legal justifications. In addition, failure to properly fulfill this obligation is also a factor in negligent behaviour becoming a crime. In this research, it is aimed to reveal that the concept has a legal nature as well as a moral dimension by analyzing the responsibilities of individuals who can fulfill the obligation of assistance and notification in the context of secondary issues. In the research, in addition to classical fiqh sources, contemporary studies were also used. The subject was handled with the analytical, qualitative data analysis and comparison methods. The research reveals that muwāsāt has an important place in Islamic law literature. Because muwāsāt plays an important role in ensuring solidarity and social justice in society. Islamic law aims to ensure that at least the basic needs of all individuals in society are met by promoting cooperation. As a result, when the meaning, purposes and effects of muwāsāt on the provisions in Islamic law are taken into consideration, it can be determined that it can shed light on the positive law system in solving today's problems.
