Abstract (EN)
The concept of 'right', which every living creation, consciously or unconsciously, demands, is among the most important terms among the relationships of religious and material in nature. Right is defined in various fields in different ways, and the limits that are in favor of, or against, someone are tried to be determined in consideration of both legal and moral as well as other matters and relationships. In this work, the notion of right, which is considered within the realm of religion and Islamic legal transactions here, will be analyzed within the scope of ownership law. The present study will examine the concept of right, which corresponds to milk (ownership) in the ownership law, within the scope of endowments law. The concepts of milk, māl, and waqf will be evaluated within the scope of the work. The theory of ownership will be examined within the scope of the law of endowments with an eye to seeking to find out whether or not a commonly accepted view with respect to ownership exists.
