Revoke of service contract with just cause by employer

Termination of service contract is the termination of the labour contract without the consent of the worker. With the termination of contract, obligations that are assumed for each side are no more applicable. However, if the termination process is not compatible with the applied law and without just cause then implied indemnity is in order. Within the listed causes for a termination in Labour Law, ?violation of job ethics and dishonesty? is a just cause for the termination of contract. Under these circumstances, employee cannot claim any obligations for the employer. On the other side, employee acts under the same rules and in parallel with the employer considering the laws undertaken. Termination of service contract by the employee with a just cause results in amends that are implied by law. In this thesis, just causes for the termination of a service contract that are listed in article 25 of Labour Law elaborated in detail; the related procedures of termination with just cause, duration of termination and results of termination are also explored. Furthermore, definition of service contract, discharge of the contract and results are mentioned in section1. As an exception; the regulations related with the termination of the service contract with just cause that are implied by Press Labour Law and Marine Labour Law are not included. The just causes for a termination of service contract that are indicated by Labour Law are the ones that imply the relationship between employee and employer is no more viable. This judgment is not a result of an ideal law; however, it is a regulated version as to make it compatible with the contemporary demands.
