Abstract (EN)

It has taken long efforts to recognize that violence against women is not just a "women's issue" but a problem concerning the whole society. This process began with the issue of violence against women being brought to the public and state agenda. Efforts have included implementing protective and preventive measures to prevent violence, ending violations of women's rights stemming from being human, ensuring that women exercise their rights both in the public and private spheres, and increasing women's visibility. Consequently, practices aimed at solving the problem of violence against women have been developed, measures have been taken, and legal regulations have been made. In Turkey, Law No. 6284 was enacted to prevent violence against women, protect women victims of violence, take necessary steps to empower women, and develop practices to rehabilitate perpetrators of violence. However, it is evident that Law No. 6284 has been inadequate in preventing violence against women, and this issue continues to occupy a significant place in the media and public agenda as one of the major contemporary problems. The increasing dimensions of violence day by day necessitate questioning the adequacy of Law No. 6284 in achieving its purpose and the effectiveness of the protective and preventive measures and the deterrence of penalties implemented under the law. This study questions why Law No. 6284 is not effective in preventing violence and explores the perspectives of actors actively involved in the fight against violence. The effectiveness of the protective-preventive measures and penalties implemented under Law No. 6284 and the entire law in preventing violence, the social source of violence, why violence cannot be prevented, the deficiencies and mistakes in the implementation phase of the law, the reasons for the recurrence of violence, are examined and evaluated from the perspectives of the actors in the fight against violence, including Law Enforcement (Police and Gendarmerie), Family Court, Bar Association (Lawyers), University (Erzurum Ataturk University), Municipality (E.B.B.) and Non-Governmental Organizations (KADEM).
