Abstract (EN)

The ombudsman (ombudsman institution) was first established in Sweden in 1809 with a constitution and has been a constantly evolving system since then. The ombudsman is a body appointed by the legislature and created to act independently against the government. The ombudsman institution, which processes, examines and supervises the applications of people who are victims of administrative practices, is an institution that detects an injustice committed by the administration. As a result of this examination and inspection, it takes the necessary measures. Studies on the practice of ombudsman in Turkey started in the 2000s and the Ombudsman Institution Law No. 5548 was passed by the Turkish Grand National Assembly in 2006. However, it was suspended due to some problems. Then, the 74th article of the Constitution was amended to establish within the Turkish Grand National Assembly and its duties were clarified. In 2012, with this amendment, The Ombudsman Institution Law No. 6328 was enacted in the Turkish Grand National Assembly. It started its activities in 2013 by accepting complaints. The objectives of this study are 1) the concept of ombudsman, its history, duties-powers, types, and the structure, 2) functioning and functions of the Ombudsman Institutions in the world and in Turkey.
