The place and significance of public supervising in the supervision of public in Turkey

Abstract (EN)

Public supervising institution, the origin of which dates back to 18th century, appeared in Swedish for the first time. Increasing functions and complicated structure of the state became influential in the appearance of this institution. Especially after the World War II with the increase of significance given to human rights, public supervising and started to be practised, by making changes according to administrative, judicial and special needs of each country, in many countries whose political, social, cultural, economic, demographic and acreage features are different from each other.Public supervising is an institution that studies the complaints coming from the public, which is related to procedures and deeds that the administration undertakes, and searches for solution ways. Its function has been not to leave the person alone against the administration, to defend his/her rights and trace the applications and condemnations. Public superviser is equipped with the authorities such as investigating and researching, criticising, announcing the problematic sides of administration to the parliament and public opinion. Although its decisions have no strings attached, its biggest power is the public opinion and the report it represents to parliament every year.In our country, the supervision of administration is carried out through ?administrative supervision,? ?political supervision?, ?judicial supervision?, ?supervision of public opinion? and ?international supervision.? Nevertheless, every supervision mechanism has particular shortcomings. Public supervising must be set up in order to eliminate these shortcomings, to realize the goal of being a democratic and judicial state respectful of human rights and to ensure the merge between the state and nation.Our study, prepared in a congruity of this point, is composed of three parts. In the first part of our study; the introduction of public supervising, the reason for its appearance, its particulars, tasks, authorities, responsibilities and types have been examined in detail. In the second part, the applications of public supervising in different countries have been mentioned, similarities and disparities have been put forth. In the third and last part, the answer to the question `what kind of a public supervising institution must be constituted? has been sought by giving place to institutions similar to public supevising in Turkey, arguments intended for the constitution of this institution.
