Abstract (EN)
While the need for transportation has increased rapidly with the spread of urbanization, transportation activities have also diversified with the development of technology. While carrying out transportation activities, which can be subject to a general classification as airlines, maritime, railway and highway, the occurrence of undesirable situations has led people to worry both on behalf of their property and on behalf of their health. Due to this concern and the need for assurance, insurance has gained importance, and as the activities have diversified, insurance has also developed in response to this diversification. With the geographical characteristics of our country being the most important factor, the most developed transportation network, extending to almost every geography and being economical, the most preferred type of transportation has been the highway. However, accidents are frequently experienced during road transportation activities due to both the lack of care and attention of the subjects and the defects in the vehicles used. As a result, there may be loss of life and property. Although in our law, losses caused by accidents on highways can be compensated on the basis of contractual and tort liability, there are also consequences that endanger human health, which cannot be reduced to an economic dimension. In particular, an accident that may occur during passenger transportation activities may reach a dimension where dozens of people may lose their lives. For this reason, due to the value given to human health and bodily integrity in modern law, this dangerous activity is intended to be secured by a life insurance in addition to those responsible and liability insurers. As a result, Road Passenger Transportation Compulsory Personal Accident Insurance was established by taking into account the mass importance and social requirements specific to passenger transportation. This type of insurance is regulated as a type of life insurance, and unlike other liability insurances, it is aimed to prevent the victimization that may be experienced after the accident with its features aimed at protecting the effects of the accident sources as soon as possible without entering into a compensation relationship with the persons affected by the accident due to loss and damage. Upon the occurrence of the undesirable situation, the persons who are passengers in the transportation contract, drivers and driver assistants become insured in the insurance contract, while the insurer is obliged to provide protection to the persons whom it has numerical information when the insurance contract is established. It is aimed to reflect the principles of insurance to this activity and to secure the health of the persons by establishing a compulsory insurance contract in favor of the subjects of the transportation activity by those who carry out the transportation work themselves.
