Abstract (EN)

ABSTRACK Financial capability of union depends on members dues payments obligation. Membership dues, is the basic source of union's income and it is necessary to collect effectively and in a good order. Both in developed countries and in developing countries, in the collection of the union's dues, with depending on different reasons the same problems can see. The direct collection of dues from each member is a highly complex system an it needs a high amount and also it results as deduction in union incomes. Check-off signifies the system of witholding of union dues from workers' remittances by employers and sending to union. The aim of this system is to grant the completing of the obligation of payment by the member workers individually in order to supply a continuous incomes to union. The securing of financial capability effectively that depends upon union members, is the most important condition of establishing independent and effective union. In the first part of the work, system is examined from economic, law and social politic aspects, and it also contains two different thoughts and points of view. In the second chapter, in different law of countries, arrangements that are dealing with the check-off, and different application methods are searched. In the third chapter, the juridicial or legal arragements in the Law of Republic of Turkey, are examined in historical and social basis, and the decisions of court of Appeal deals with the application is arranged. In the conclusion chapter, evaluation are expressed. Theorically, Check-Off system is a discussion subject, beside it protects its function in the development of unionship actions. Our opinion is to protect the system as a security of union.
