Abstract (EN)

Human beings instinctively feel compelled to take precautions before harmful events occur. As a result of these precautions, human beings need insurance to protect themselves from the economic consequences of damaging events they would face. Since the insurance does not comply with Islamic law due to factors such as interest and uncertainty, Islamic insurance has found a development area in accordance with Islamic law. Since the main purpose of Islamic insurance, whose application area has increased rapidly since its emergence, is the execution of insurance activities within the framework permitted by Islamic law, it is important to investigate the structure, types, basis, legal nature and duties of the advisory committee, which has the most important function in determining compliance with Islamic law and making it public. Considering these issues and reviewing the literature, in this thesis, the structure, function and legal nature of the advisory committee are discussed. Within the framework of the results, it is aimed to contribute to the shaping and development of the advisory committee structure in Islamic financial institutions where Islamic insurance activities are carried out in Turkey.
