Abstract (EN)
The conservation of urban areas that include dense cultural heritage is considered for the first time in the Congress of Architects in Madrid in 1904 globally. In this thesis, the legal process from 1983 that might be acceptable as the beginning point of the conservation of cultural heritage and areas in Turkey and the legal arrangements, announced in 2004, that aim to solve the problems related to (or caused the failure in) conservation are evaluated in terms of the preparation and application of conservation plans.A new approach in conservation is recently needed due to the structural problems occurred in the organisation of managerial authorities responsible for the conservation, the insufficiency of traditional planning methods that are still in practice to solve the problems of the cultural heritage areas, the limited content of the conservation plans that are not able to present policies and strategies beyond the physical decisions and the lack of interest from stakeholders in the conservation areas.Recently, the new instruments such as ?area management?, ?KUDEB (The Bureau for the Conservation, Application and Controlling)? and ?Financial Contribution Share? have been put into practise to support the preparing and application process of conservation plans. These instruments aim to eliminate the practical difficulties caused by the traditional planning approach that pays no attention to the stakeholders and that has the lack of financial source and technical staff. In this study, the contributions of recent legal arrangements to the preparing and application process of conservation plans are examined in the Revision Conservation Plan of Giresun Urban Conservation Area as the case. The study is finalised with the suggestions and proposals that are developed to solve the problems that are faced in preparing and application process of the Conservation Plan.
