Abstract (EN)

Continuous capital accumulation is required for continuous growth and continuous profit, as the continuous capital accumulation, it makes the "continuous flow" possible by making the commodity, capital and labor to expand into wide geographical areas and eventualy a new division of labor appears worldwide, in a loss of meaning in the nation–state border. The transformation of capitalist economy globalizing and turning into a modern "world system" as mentioned by Wallerstein is briefly just like that. Turkey was relatively out of this system until the 1980s with the import substitution strategy which the planned economy dominated. The articulation process of capitalist economy that started in 24 January 1980 affected not only the market but also the society by all means. In this new process the state which passed the major role to companies (to market) was going to withdraw from the economy slowly. Society also, in this new process, was going to enter into the process of rapid cultural transformation with the massification of the communication and the dazzling internet technology and was going to catch up with the third wave of the Toffler even tough it came from behind. It was not possible for the law which is a social phenomenon beyond being an order design, to react to this transformation which has occured within the state, society and market on the contrary of the processes and conditions which constitute the social reality. In this context it can be said that the economical, technological, political and cultural processes that ascertain globalization are the same processes that globalize the law. This study aims to research the globalization – law relationship with a sociological view on the global relations and understanding which has permeated into the spirit and the word of the Turkish Commercial Law in force with this point of view.
