Abstract (EN)
The usual behavior of the defendant after the duly served notification is to submit a response petition stating his responses to the case. However, the defendant is not obliged to file a response petition against the lawsuit filed against him. The defendant, who prefers not to file a response petition against the lawsuit brought against him, will have to endure some negative consequences of this situation. The defendant, who does not submit a response petition, will be deemed to have denied all the facts included in the lawsuit petition pursuant to Article 128 of the HMK. In this case, the defendant can only defend himself in the context of denial, present evidence in the context of denial, and the trial will now be shaped in that direction.
