Abstract (EN)
Legal disputes between the parties are resolved and decided by the judicial organs. The parties are obliged to prove their justification ragarding the dispute. Proof will be done through evidence. Evidence is important in order to reach the materıal truth at the end of the trial. The purpose of the detection of evidence is to examine the evidence thorugh the court in order to prevent the loss of evidence in urgent cases. Evidence is a temporary legal protection in nature. The subject of the determination of evidence is material facts. In order fort he evidence to be determined, there must be a demand. Courts can not decide on the determination of evidence on their own. Since the determanition of evidence is not a final decision, it can not be brought to legal action, but it is possible to object to the detection of evidence.
