Custody in private international law

Postgraduate thesis study consists of four sections. In the first section; the legal property of custody, rights and liabilities of the parents born from the custody and the termination/expiry of the custody are hereby assessed along with the Supreme Court's decisions. Thus, it is hereby aimed that the custody should form a theoretical basis in terms of Turkish Law in the following sections of the study. In the second section; the emphasis is lad down over the determination of the law which shall be applied on custody disputes. In the third section, the international authority of the Turkish courts shall be discussed for the foreign custody disputes according to the internal law and relevant international contract provisions as well as under the consideration of Supreme Court's decisions, whereas in the final section; the recognition and approval of foreign custody disputes are being dwelled on. At the same time, the social structure which is changing according to the age's requirements have some effects on the custody. At this point, the common custody, custody issues in surrogate motherhood and in relations with same genders hereby arose as such issues where debates were being faced up both in terms of private law and internal law and where some legal arrangements were being made in some states. For this reason, the custody problems which are revealed by such issues in this study were examined in relevant sections and the study was finished accordingly.
