Evaluation of Muhammed Saîd Ramadân al-Buti's opinions on family law (specially his fatwas)

This study examines the views of Ramadan al-Butı, who holds a significant place in the field of contemporary Islamic law, regarding family law, and evaluates these views in relation to both classical Islamic jurisprudence and current legal practices. Al-Butı is a scholar who, while adhering to the fundamental principles of traditional Islamic law, also made ijtihad (independent reasoning) to address the needs of the modern era. His ideas conceming key issues such as engagement,marriage, wedding ceremonies, divorce, alimony, guardianship, adultery, waiting period ('idda), seclusion (khalwa), and the role of women within the family form the main focus of this study. The thesis first provides general information about al-Buti's life. It then examines al-Buti's methodological approach, examining his understanding of the principles of jurisprudence (figh); then, a systematic analysis of his views on family law is provided. Al-Buti presents both traditional and modern approaches to family matters. Furthermore, a comparative assessment is made of the extent to which his views align with or differ from the family law systems practiced in contemporary Islamic countries. In conclusion, it is determined that al-Butı strives to offer solutions that are faithful to the dynamic structure of Islamic family law while responding to contemporary needs. In this regard, his work serves as a significant reference for both academic circles and legal practitioners. This thesis aims to contribute to a broader understanding of al-Butı's perspectives and to shed light on current issues in Islamic family law.
