Abstract (EN)
Property right is one of the most important rights that mankind owns. It has been maintaining its importance since the beginning of human existence. Nonetheless, it is not an unrestricted right. Thus, it can be restricted and intervened under certain circumstances provided by laws. Human beings' instinct of living together has brought about the urbanization and expansion of cities. As a result, irregular settlements and unplanned urbanization have arisen, and the needs regarding public security, public health and public interest were put at risk. Therefore, the needs related to organising urbanization and establishing public spaces have occurred and the concept of zoning has emerged. To meet the objectives stated, a number of interventions are implied towards the property right by zoning actions. Act of parcelling, which has been one of the most important steps in respect of the concept of zoning and Zoning Law, is an administrative process that intervenes the property right. Land or share on a land belonging to its owner is directly affected by the authorized organs of state's act of parcelling. It is needed to be set forth the ways and limitations of intervention in parcelling that has undeniable effects on property right in order to prevent forfeitures and arbitrary acts of authorities. This study has been prepared in four chapters with the purpose of being beneficial to authorities and right holders. General information is given in the first chapter related to property right; and in the second chapter general information is given regarding the plans in order to understand the parcelling proceedings. After parcelling is discussed in the third chapter, the interventions to property right within the acts of parcelling is scrutinised in the fourth and the last chapter.
