Abstract (EN)

Insurance is an establishment of people that are face to face the risks of identical and similar qualities in order to meet the risks together. These risks cannot be met alone. The Turkish Commercial Code regulated the situations of what would happen if the insured or the beneficiary or the people who the insured or the beneficiary is legally responsible for their actions is at fault when the payment of insurance indemnity is going to make. The Turkish Commercial Code regulated the clause number 1429 in the chapter of general provisions that are applicable of every type of insurance contracts. In the terms of the effect of risk occasioned by the negligence on the insurance indemnity in liability insurance, The Turkish Commercial Code specifically regulated the clause number 1477. And finally, in the terms of the effect of risk occasioned by the negligence on the insurance indemnity in personal insurances, The Turkish Commercial Code specifically regulated the clause number 1503 which arranges the suicide of the insured and the clause number 1504 which arranges the murder of insured by the beneficiary. According to these regulations if the risk occasioned by the negligence, taking account of the level of the fault or the fact that whose at fault, the insurer may not pay the insurance indemnity at all or may mitigate the surrender values.
