Abstract (EN)
Al-Marqinānī elaborates Hanafi legal schools' thought in his notable book al-Hidāya. All topics of Islamic law have been covered in general. Judgments of Imam Shafiī have been quoted in different ways within this work, for instance, they have been quoted directly by mentioning his name or indirectly by mentioning his agreement or disagreement with Hanafis' judgments. The main hypothesis of this thesis is that some of these judgments directly or indirectly attributed to Imam Shafiī in the chapter of "Worships" in this book does not belong to him. Thus, we will determine the views attributed to Imam Shafiī and verify them in terms of belonging to Shafii. We have examined out of 194 judgments credited to Imam Shafiī in al-Hidāya and have found out 39 of them had been mis-quoted. We have also examined and compared ideas of Hanafi and Shafiī legal schools' thoughts on religious practices in detail. Keywords: al-Hidāya, al-Marqinānī, Imam Shafiī, Worships, Religious practices.
