Judgement procedure in insurance arbitration

Arbitration is a way to resolve disputes outside the courts for any dispute between the parties. Arbitration, one of the alternative dispute resolution methods, is gaining more importance in our country and in the world. Insurance Arbitration Commission was established by Article 30 of the Insurance Code in order to resolve disputes between policyholder and Insurance companies, beneficiaries of the insurance and insurance companies or beneficiaries of the assurance account and assurance account. The Insurance Arbitration Commission is composed of the chairman of the commission, commissioner and deputy directors, rapporteurs and other employees. The subject of our thesis is the Judgement Procedure in Insurance Arbitration and we will focus on the concepts of insurance and arbitration. In the continuation of our thesis study, insurance arbitration will be explained in comparative legal systems, the organization structure of the arbitration commission will be mentioned and finally, in the case of insurance arbitration procedure will be examined. In addition to the large contribution of insurance arbitration to our judicial system, there are also some legal deficiencies related to insurance arbitration. Waiting for these deficiencies to be solved by the practitioners is in contradiction with the principle of the rule of law. For this reason, issues related to insurance arbitration, especially in the doctrine should be resolved as soon as possible. The benefit expected from the arbitration will increase in this way and the path of an exemplary arbitration system will be opened with its stabilized practices.
