Liability of the insurer of liability for damages

In the liability insurance business, the liability insurer aims to compensate the consequences of the damage arising at the responsibility of the third party, who suffered as a result of the unlawful act of the insurant, which constitutes the basis for the risk stipulated in the insurance contract, within the limits of the insurance amount stipulated in the insurance contract. The injured third party may demand the elimination of the consequences of the damage caused by the liability law from the insurer, as well as from the liability insurer due to the insurance law. It is stipulated in Article 1484 of the TTK that even if the performance obligation of the liability insurer is partially or completely terminated against the insured, it will continue until the compulsory insurance amount against the third party damaged. The regulation in Article 1484 of the TTK, which holds the liability insurer liable to the third party damaged in any case, has left the liability insurer vulnerable. In our concrete thesis, the liability of the liability insurer to the third person who suffered damage has been discussed in three parts within the scope of TTK article 1484. In the first part of our study, the parties of the liability insurance contract within the scope of the TTK, the obligations of these parties and the general regulations regarding the liability insurance contract are discussed. In the second part of our study, what defenses the liability insurer can put forward against the injured third party in line with the compensation claim of the third party are discussed. In the third part of our study; In which cases the liability of the liability insurer against the injured third party will come to an end has been discussed.
