Abstract (EN)

Nowadays the advancement in technology and the development of mass media have undoubtedly increased the intervention of the investigation through the press. In this respect, it is of great importance to bring legal restrictions to press freedom in order to ensure proper uses of the freedom of the press and to prevent interventions to the confidentiality of the criminal investigation. Criminal procedure consists of two phases: investigation and prosecution. The content of the proceedings in the investigation phase is confidential. The prosecution phase should be carried out on the basis of public disclosure. Therefore, the regulation and limitation of the freedom of press in terms of reporting of casees by the press is important for the achievement of the purpose of criminal procedure. In the first chapter in order to present the title of our research in a convinient way, firstly, we explain the general information about the concepts of "press", "freedom of press" and "crime of press". In the second chapter of this study, two different types of crimes are examined under the same heading: public violation of the confidentiality of the first paragraph of Article 285 of the Law No. 5237 (Turkish Penal Code) of the Turkish Republic.
