The administration's struggle with dangerous epidemics diseases within the scope of the social state principle

Combating dangerous epidemics is an essential issue that many states, including our country, should attach importance to in order to build a healthy society and maintain public order, and to produce solutions in this direction. The importance of this issue has been better understood with the current Covid-19 epidemic. In accordance with the concept of "social state" that emerged in Western democracies in the twentieth century, states were expected to actively intervene in economic and social life in order to ensure social peace and social justice. Therefore, as a reflection of the social state understanding, states should ensure that individuals live in prosperity and take measures that protect their right to health. When it comes to combating dangerous epidemics, the administration carries out these measures through police power to protect public health. In this regard the objective of this thesis is to determine the responsibilities, duties and authorities of the administration, to struggling with epidemic diseases, which are one of the biggest risks in the protection of public health and expressed as "dangerous epidemic diseases" in our Constitution, within the scope of the social state principle specified in our Constitution. Accordingly, first of all, the importance of the positive obligation of the state in combating dangerous epidemics, within the framework of the social state principle, was required to put forward. For this purpose, the relationship between the social state and the right to health has been explained, by handling the importance of protecting public health in realizing the right to health and epidemics have been examined with the administrative law discipline approach. In this direction, the interdisciplinary discussion of the subject in recent times has been taken into account, and resources from different disciplines have also benefited. In addition, the law enforcement activities of the administration in combating epidemic diseases and the limits of compliance with the law while performing these activities are explained with the most recent court decisions and the subject has been tried to be explained within the framework of administrative law.
