Abstract (EN)

Rapid technological advancements have had a significant impact on several areas of human life, including education, health, and work. As technology is increasingly used in all aspects of life, many communication tools are also used during the preparation of a crime or while committing a crime. As technology has advanced, it has become more difficult to clarify the crime and identify the perpetrators. As a result of this situation, states have taken some measures through the use of technology in order to combat crime and obtain material fact. The aim of criminal procedure law is to reveal the material fact. Judges utilize legal evidences while reaching the material fact. In criminal procedure law, measures of protection are applied in order to obtain evidence. One of these measures of protection is supervision of communication through telecommunication. In this study, the supervision of communication via telecommunication is examined in three parts. In the first part, the concept of supervision of communication via telecommunication and its relationship with fundamental rights and freedoms are analyzed in general terms. In the second part, the types of surveillance of communication via telecommunication in Turkish Criminal Procedure Law and the conditions for the application of the measure and the termination of the measure are addressed in detail. The last part the evaluation of the evidence obtained as a result of measure is analyzed.
