Abstract (EN)
The subject of this master's thesis is the protection of unregistered trademarks according to unfair competition. The most common unfair competition act that may occur in practice in terms of unregistered trademarks is regulated under TCC Art. 55/1-a-4. The likelihood of confusion in TCC Art. 55/1-a-4 is essentially a concept originating from trademark law. Therefore, the interpretation and principles of trademark law are taken into account in determining the likelihood of confusion that may arise within the scope of unfair competition regarding unregistered trademarks. These interpretations and principles are applied to the concrete case to the extent appropriate to the nature of the unfair competition. In our study, firstly, the acquisition of the trademark right in terms of unregistered trademarks is discussed, then how unfair competition may occur in unregistered trademarks and the methods of protection against unfair competition are emphasized.
