Abstract (EN)

In the present conditions in which the natural environment is non-renewable, the forests have been destroyed; as a result, they have faced the threat of extinction day by day. It has been a necessity to protect forests, the world?s lungs. Therefore, certain legal arrangements have been made in Republican Era. It is no doubt that the highly disputed issue, especially after the 1950?s, in the legal arrangements is the degraded forest lands. In 1961 Constitution era, an enacted legislation concerning the process of taking out of timber lines was abolished by the Supreme Court. Thus, 1961 Constitution was modified in 1970, and the provisions which enabled to be taken the degraded forest lands out of forest area were included. In addition, 1982 Constitution made the process of taking out of forest area constitutional by extending the provisions of 1961 Constitution. On the basis of 1982 Constitution and the second item of Law No. 6831, in 2012, Law No. 6292 ?about Promoting the Development of Forest Peasants and the Improvement of the Areas taken out of Timber Lines for Treasury and the Sale of Public Agricultural Lands? was enacted by GNAT. In our study, in accordance with the provisions of Law No. 6292, the legal situations of the degraded forest lands will be examined. Key Words 1- the degraded forest land 2- 2/B 3- Law No. 6292
