Abstract (EN)
In this study, the crimes of breach of confidentiality, which are regulated by the Turkish Penal Code (No. 5237) in the Article 285, among the crimes against judiciary, is examined. In the first place connection of the crimes stipulated in the Article 285 of the Turkish Penal Code with the concepts of human rights, constitutional rights, right to a fair trial, right of defense, presumption of innocence and equality of arms is explained. Then the concept of confidentiality and the other principles relating to these crimes are discussed. Later, elements of the crimes prescribed in the Article 285 of the Turkish Penal Code are observed in detail.
