Abstract (EN)

In criminal proceedings, it is aimed to restore the social order that has been disrupted by punishing the criminals. The statute of limitations for litigation results in the termination of the state's right to punishment. In our national law, the statute of limitations is regulated in the Turkish Criminal Code. In addition, some special criminal laws contain regulations on the statute of limitations. The impact of every crime on society is not of the same nature. Therefore, the statute of limitations stipulated in the law for offenses of different nature and gravity is not equal. Considering its impact on the social order, some crimes were excluded by the legislator from the scope of the statute of limitations. This institution was found worthy of examination in the face of the impact and importance of the consequences arising in the event of the statute of limitations in the case.
