Abstract (EN)

Disasters not only cause vital losses and damage the built environment, but also damage the historical, social, cultural and economic structures of the society in which they occur. Each disaster had different consequences and expected different solutions. In parallel, the application and legal process have also changed over time. From the Ottoman Empire to the present day, the disrupted lives of disaster victims have been supported, opportunities have been offered for them to resume life again, and a number of studies have been undertaken by the state. All the studies conducted were seen as a necessity rather than an understanding of the welfare state. Because disasters develop suddenly and do not make choices on any section of society. Therefore, this process, which develops outside the will of people, is accidental. Situations such as the evolution of the welfare state into a mixed welfare state structure, the change of the ownership structure and the ownership of rights have also caused the conditions offered to disaster victims to change. Risk sharing comes to the fore here. Now the risk posed by the disaster is shared not only by the state, but also between the civil sector, the private sector, the voluntary sector, religious organizations, and the state is again in the Decenter position. It is considered to be the most costly and difficult process improvement stage in disaster management. In this context, in the case of the Izmir Earthquake on 30.10.2020, while the state is about to complete the disaster housing built for rights holders in destroyed, emergency or severely damaged structures in the reconstruction activities carried out under Law 7269, there is no similar situation for rights holders in moderately damaged structures under Law 6306, despite the passage of three years. When the reconstruction process within the framework of international regulations such as the welfare state system, the Universal Declaration of Human Rights, the European Social Charter, Habitat Conferences and the legal framework is evaluated as a result of survey studies conducted in different damage groups, it has been concluded that there is an inequality and it has a enlightening quality for the reconstruction process after possible disasters.
