Abstract (EN)
The regulation is a means that the governments use for governing complex anddeveloping communities and economy and also for balancing the competitive interests.The governments issue economical, social and administrative regulations. At our country,some regulations, which are constitutions, laws, a decree having force of law, agreements,regulations, by-laws and other administrative regulations have been taken in to effect. But,some times later, the regulations have become a subject of reform for public administrator.The deceleration of economy and the weakness of financial structure cause re-structuringof the traditional regulations system in the sense of benefit and cost. First of all, the systemof drafting law should be identified for re-structuring the system. Some basic information isgiven about making regulation system at this study. While the process of makingregulation is explaining, necessities of designing of this process in accordance withprinciples of Regulatory Reform Program and Better Regulation Program which areimplemented by OECD and European Union.There is no any law about making regulation system in Turkey. But, there was thePrinciples which was executed by Prime ministry about this subject up to 17 February,2006. At this date a new regulation which is called By-Law on The Procedures andPrinciples of Regulation Drafting came into force. This By-Law regulates the draftingregulating procedures. Before this regulation there is an inconsistency with principles ofbetter regulation which are stated by OECD and EU. But a new regulation consists ofprovisions that provide transparent and consultative system for preparing regulation. Inaddition to that, integration of regulatory impact analysis that stipulates the clarification ofcost and benefits into the Turkish making regulation system is a very importantdevelopment. We should know that good regulation cause a good administration andcitizen satisfaction.
