Abstract (EN)

Asylum, which results from the abuse of the fundamental human rights, has been going on for a long time up to now. Despite the rules of the international law, many difficulties are encountered due to the various specific practices of countries. As on the international stage, Geneva Convention of 1951 is regarded as the base of the refugee law in Turkey as well. Turkey was one of the signatories of the convention. Despite this, the issue of asylum has become a serious problem due to the non-systematic practices of internal authorities regarding the rights of the refugees-asylum seekers. Turkey has been going on its attempts to constitute an institutional and professional system for the issues of asylum and migration.In the present study, firstly a global look into the problem of refugees is provided focusing on the basic concepts about the topic. The concept of asylum in international law, the status and the rights of the refugees has been analyzed. By touching on the background of migration and asylum in Turkey, national asylum legislation and legal arrangements are explained. Finally, by analyzing the existing problems regarding the achievement of the refugees-asylum seekers? rights, the things which are to be done have been put forward as suggestions in order to eliminate the problems and to achieve the operation of the international law rules in accordance with its requirements.
