The evaluation of the legal ground and policy documents for special gifted individuals in Türkiye

The most important fund of countries are manpower. Enabling manpower an effective education and employment opportunities to shape the future of the country is stated as an important issue. Individuals with special talents, who have a faster learning process compared to their peers, have academic skills that are ahead in creativity, art and leadership capacity, can understand abstract ideas, like to act independently in their fields of interest, and perform at a high level; constitute the locomotive power of human capital. The importance of education programs in raising qualified human capital is an issue that the whole world focuses on, develops legal protections in the field and produces policies. One of the basic functions of education is stated as bringing individuals' current potential to force at highest level by enabling individuals to develop in the line with their abilities. The application of the right to education, which is a fundamental human right, to every child born with different cognitive abilities, with an understanding of absolute equality, brings along a result contrary to the basic function of education. The fact that a country has a policy regarding the gifted children, who were born with a gifted intelligence and special talents, to realize their and contribute to humanity and their country, means that the country is aware of the source in its hands. To use human capital in a correct and effective way, policies and practices should be developed for the field for gifted people that require special education. Although our country, which is very rich in terms of qualified human capital, has made progress in many areas, it cannot be said that it has reached a sufficient level in developing and implementing policies specific to gifted individuals. In this study, besides the constitutional and legal studies on the field of gifted people, other legal norms related to the subject have been examined in the process that has developed from the beginning of the history of the Republic to the present; evaluations were made on the implementation aspects of the regulations in development plans, council decisions and other policy documents.
