Abstract (EN)
The acquisition of immovable property by foreigners is an area where intensive debates are taking place in our country, including the republic period and before, and it has been the subject of changes in Turkish legal legislation many times and constitutes the agenda of the amendments. In Turkish law, the acquisition of immovable property by foreign natural and legal persons is regulated in a dispersed structure. Foreigners can have their rights over immovable property in Turkey, essentially the 2644 Deed to the Law No. 6302 are dealt with amendments by Law. In this study, the conditions and restrictive regulations regarding the acquisition of immovable property of foreign real and legal persons in our country are examined especially within the legal framework set out by the Land Registry Law. The most important amendment to the Land Registry Law in 2012 was the abolition of the reciprocity requirement for the acquisition of immovable property by foreign natural persons. Amendment, foreign real and legal persons instead of reciprocity in order to obtain real estate and limited real rights in Turkey, the Council of Ministers must be citizens of one of the countries determined by the Board were introduced. In the new system, with the abolition of the Council of Ministers with the amendment of the 2017 Constitution, all duties assigned to the Council of Ministers were transferred to the President. Therefore, in the historical process of the Land Registry Law, the powers of the Council of Ministers will now be used by the President. Thanks to the regulations of the law, the acquisition of immovables by foreigners in our country has been facilitated.
