Abstract (EN)

Since 2011, more than four million Syrians have been forced to emigrate to our country due to the conditions of war in their country. A certain part of the Syrian asylum seekers has settled in our country, and another part has tried to cross into Europe. Syrian asylum seekers living in Turkey face many problems in daily life. At the beginning of these problems are the exposure of Syrian asylum seekers to migrant smuggling and human trafficking. At this point, it is seen that women and children in particular are the subject of human trafficking. In other words, Syrian asylum seekers living in Turkey are open to abuse in terms of migrant smuggling and human trafficking. For Syrian asylum seekers living in Turkey, migrant smuggling and human trafficking are crimes that still remain serious. In the name of combating these crimes, the Turkish Criminal Code No. 5237 regulates migrant smuggling and human trafficking crimes. The aim of this study is to make a legal analysis of the exposure of Syrian asylum seekers living in Turkey to migrant smuggling and human trafficking crimes. The main problem of this study is to examine the regulation of the migrant smuggling and human trafficking crimes in the Turkish Penal Code No. 5237 that Syrian refugees living in Turkey are exposed to.
