International contract management

In this study, we reveal the international operation of the contract management process and clarify the important items of the contract contents and the contract types. The issues that need to be taken into consideration while preparing the contract are put forward in order to settle the disagreements that may arise between the parties in international contract management. Although the contract is prepared in an appropriate manner we consider that these disagreements may arise. Therefore, we mention about the consultant who acts as a kind of referee between the parties in international contract management and his importance. The contractor's responsibilities are discussed. For the contract management, we investigate the problems encountered frequently through the FIDIC contract example and the ways to be tracked in case of disagreement within the FIDIC contract terms. We explain the most frequently used articles of the FIDIC contract which is taken as an international contract model and refer to the FIDIC contract based works in Turkey. The responsibilities of the contractor until the delivery of the job in international contracts are emphasized, and the impact of the responsibilities and risk distributions on the project cost is remarked. Business delays and extensions are examined and interviews are conducted with sample representatives of contract parties and these subjects are mainly processed during interviews
